Timing of a Homestead Declaration

If you have little equity or minimal debt, you may still be concerned for the future. In most cases, you need not worry, since you can file a homestead declaration in California easily, without expensive legal or professional help. Simply fill out the one-page form and file it with the County Recorder that oversees the location of your home. While you should file the homestead form before you have a serious financial problem, creditors cannot file liens until they obtain court judgments. You'll have plenty of notice before you need to declare a homestead.

California Homesteads

A "Declared Homestead" is a document that is filed to protect a homeowner's equity from most creditors. This protects the property’s equity from certain debts, judgments, bankruptcy, medical debts, liens arising from accidents, and other types of involuntary liens. However, the homestead will not protect the property's equity from construction liens, mortgages, government liens, child support, alimony, and voluntary liens that a homeonwer has consented to. A homestead is filed once and will remain effective until the house is sold or an abandonment of homestead is filed.

Homestead Acts

The Homestead Acts were several United States federal laws that gave an applicant ownership of land, typically called a "homestead", at little or no cost. In all, more than 270 million acres of public land, or nearly 10% of the total area of the U.S., was given away free to 1.6 million homesteaders; most of the homesteads were west of the Mississippi River.
